Framework for updating the VTS Manual
Input paper VTS49-8.4.1 on ‘Framework for Updating the VTS Manual’ and its associated document VTS49-8.4.1.1 (of the same title) from the VTS Manual Coordination Group, requested the Committee to note the contents of the documents.
The Committee Management Team have received no substantive comments with respect to these documents and, therefore, consider that the next stage in the process will be to submit the same documents to the Policy Advisory Panel for discussion and finalisation thereby enabling the periodic update of the VTS Manual as and when changes are needed.
The draft input paper to the Policy Advisory Panel is the same base document as VTS49-8.4.1 on ‘Framework for Updating the VTS Manual’. Therefore, the Committee Management Team would request VTS49 to note the content of VTS49-8.4.1 and approve that the document is forwarded, along with a copy of VTS49-8.4.1.1 to the next session of the Policy Advisory Panel.
Noting that no comments have been received on the input documents to date, the closing date for comments on this issue and the proposed way ahead will be Wednesday 14 October at 1000 UTC. The documents and the associated comment form can be found here.
Revised Guideline 1089

Following the silent approval process for guideline G1089, a problem has been identified with the concluding statement at section 3.1 of the draft guideline that reads “It follows, therefore, that VTSs are mandatory under national law within the territorial seas”.
It has been pointed out that the provisions of SOLAS and the IMO Resolution do not specifically state this and that a mandatory VTS would be established through national implementation rather than it “following” from the SOLAS and IMO provisions. Thus, whilst in most cases any VTS established on a permanent basis will be mandatory, the current statement is potentially open to legal challenge.
A more detailed explanation to replace the existing text would inevitably be more complex and would detract from the message of this section; it is also considered that nothing is lost through the removal of the entire sentence. It is, therefore, proposed to remove the concluding statement to section 3.1 of the draft guideline.
As a result the document is circulated for a further period of silent approval on this single issue. In view of the nature of this change and recognising that draft guideline G1089 has previously been circulated, the closing date for commenting on this single issue is Wednesday 14 October 2020, 0800 UTC. This will allow sufficient time for CMT to review any comments received. Any objection to this shortened period of silent approval should be raised as a comment.
Liaison Note to ARM and ENAV – S212 referencing assumptions

Recommendation R0103 and associated Guideline
The Committee Management Team have decided that the Recommendation R0103 and associated Guideline are both ready to send to the VTS49 Committee to seek silent approval over a period of five calendar days.
